These Terms of Service (“Terms”) govern your access to and use of the web hosting and related services provided by GalacticNode (“GalacticNode”, “we”, “us”). By creating an account, ordering services, or using our services, you agree to be bound by these Terms.
1. Your account
You must provide accurate, current, and complete information when creating an account and keep your information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activity performed through your account.
You must notify us immediately if you believe your account has been compromised or accessed without authorization.
2. The services
We provide web hosting, virtual private servers (VPS), dedicated servers, and related technology services as described on our website and during the ordering process.
We may update, improve, modify, or discontinue features of our services when necessary.
We aim to provide reliable service availability as described in our Service Level Agreement.
Some GalacticNode hosting plans may include features advertised as unlimited, such as storage, bandwidth, databases, email accounts, or other resources. Unlimited services are provided under a fair usage model and are intended for normal website hosting purposes.
Unlimited resources do not mean unlimited server capacity. Resources are shared among customers, and usage must remain reasonable and not negatively impact the performance, stability, or availability of our services.
If an account consistently uses excessive resources or impacts other customers, we may contact you to discuss optimization, recommend a service upgrade, apply reasonable limits, or take other appropriate action.
3. Subscription billing and payments
- Services are billed in advance according to the billing cycle selected during checkout, including monthly or annual subscriptions.
- By subscribing to our services, you authorize GalacticNode and our payment processors to charge your selected payment method automatically for recurring invoices.
- Subscriptions automatically renew until cancelled by you through your client area or by contacting support.
- You are responsible for ensuring your payment method remains valid and has sufficient funds available.
- Failed payments may result in service suspension or termination.
4. Pricing and changes
- We reserve the right to change pricing for our services at any time.
- Existing customers will receive reasonable notice before pricing changes affect active subscriptions.
- Continued use of services after a pricing change becomes effective constitutes acceptance of the updated pricing.
5. Refund policy
Refund eligibility depends on the type of service purchased.
New shared hosting accounts may qualify for a money-back guarantee as described in our Refund Policy.
Unless otherwise required by law, VPS servers, dedicated servers, domain registrations, renewals, licenses, setup fees, and custom services are non-refundable.
Refund requests may be denied if services have been abused, violated our policies, or caused damage to our infrastructure.
6. Acceptable use
Your use of our services must comply with our Acceptable Use Policy.
You may not use our services for illegal activities, malware distribution, phishing, spam, unauthorized access attempts, network attacks, copyright infringement, or any activity that harms our infrastructure or other customers.
We reserve the right to investigate abuse reports and take appropriate action.
7. Resource usage
Customers must use server resources responsibly and may not interfere with the performance, security, or availability of our services.
Accounts or servers causing excessive resource usage, security risks, or disruption to other customers may be limited, suspended, or terminated.
8. Backups and customer responsibility
We may provide backups, snapshots, or recovery services as a courtesy; however, backups are not guaranteed unless specifically included with your service plan.
You are responsible for maintaining independent backups of your data.
GalacticNode is not responsible for data loss caused by hardware failure, software issues, customer actions, security incidents, or service termination.
9. VPS and dedicated server responsibility
Customers using VPS or dedicated servers are responsible for securing, maintaining, and managing their installed software unless management services are purchased.
Customers are responsible for applications, configurations, security updates, and content hosted on their servers.
10. Suspension and termination
We may suspend or terminate services if you violate these Terms, our Acceptable Use Policy, fail to pay invoices, create security risks, or negatively impact our network or other customers.
Where practical, we may provide notice and an opportunity to resolve issues before termination.
Accounts terminated for policy violations may not qualify for refunds.
11. Intellectual property
All GalacticNode branding, logos, website content, and materials remain the property of GalacticNode unless otherwise stated.
You may not copy, modify, distribute, or use our branding without written permission.
12. Third-party providers
GalacticNode may use third-party providers for payment processing, datacenter services, software, security, and other infrastructure.
We are not responsible for interruptions caused by third-party services outside of our reasonable control.
13. Limitation of liability
To the fullest extent permitted by applicable law, GalacticNode shall not be liable for indirect damages, lost profits, business interruption, loss of data, or other consequential damages.
Our total liability related to any service shall not exceed the amount paid by you to GalacticNode during the three months immediately preceding the event giving rise to the claim.
14. Indemnification
You agree to defend, indemnify, and hold harmless GalacticNode, its employees, partners, and providers from claims, damages, losses, or expenses resulting from your use of our services, your content, or your violation of these Terms.
15. Changes to these Terms
We may update these Terms from time to time.
Updated Terms will be published on our website. For significant changes, we may provide notice through email or your client area.
Your continued use of our services after changes become effective means you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of the United States and the State of Ohio, without regard to conflict of law principles.
Any disputes relating to these Terms or our services shall be handled under the applicable courts located within Ohio, United States.
